These Terms of Service ("Terms") govern your access to and use of the MisterShell website at mistershell.com (the "Site"), operated by MisterShell ("MisterShell", "we", "us", or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal or internal business purposes, subject to these Terms. You must be able to form a binding contract to use the Site.

2. The software is licensed separately

The Site provides information about the MisterShell software and related services. The MisterShell software itself is self-hosted and licensed to you under a separate software license agreement. Nothing on the Site or in these Terms grants you any rights in the software beyond those set out in that separate agreement. Free evaluation use, where offered, is subject to that agreement.

3. Acceptable use

You agree not to:

• Use the Site in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to the Site or its underlying systems.
• Interfere with or disrupt the integrity or performance of the Site.
• Introduce malware or any other harmful code.
• Scrape, harvest, or collect information from the Site by automated means except as expressly permitted.
• Use the Site to infringe the rights of others or to transmit unlawful or objectionable content.

4. Intellectual property

The Site and its content — including text, graphics, logos, and design — are owned by or licensed to MisterShell and are protected by intellectual property laws. The MisterShell name and logo are trademarks of MisterShell. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from the Site without our prior written consent.

The Site may contain links to third-party websites or services that we do not control. We are not responsible for the content, policies, or practices of any third party, and your use of them is at your own risk and subject to their terms.

Your use of the Site is also governed by our Privacy Policy, which explains how we handle information collected through the Site.

You agree to indemnify and hold harmless MisterShell and its affiliates, officers, and employees from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of your use of the Site or your violation of these Terms.

We may modify the Site or these Terms at any time. When we change these Terms, we will update the "Last updated" date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

11. Termination

12. Governing law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which MisterShell operates, without regard to its conflict-of-laws principles. The courts of that jurisdiction shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Site.

13. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with the Privacy Policy and any separate software license agreement, constitute the entire agreement between you and MisterShell regarding the Site.
